Definition: Eng. law. A declaration may be filed without a new process or writ, when the defendant is in court in another case, by the plaintiff in that case having filed common bail for him, the declaration thus filed is called a declaration by the bye. 1 Crompt. 96, Lees Diet. of Pr.
