If an employer pays an employee in cash and the employee gets injured on the job, can teh employee file a claim for workers comp?

Is the employee on payroll or "off-payroll"? If he is off payroll, then he would have to report the employer to the unemployment office and the employer would get in trouble for not paying taxes on the employee's wages. If the employee is on payroll but gets paid cash, then of course he can claim workers comp.
