My aunt is acting as trustee of my grandfather's trust and estate. My grandfather passed in January. My family has not received any information about the trust and we have asked twice for information. We dont think that she is competent to administer the trust nor does she have the time or energy to be trustee. We would like to see the trust so that we can remove her, but we still have not seen the trust. Procedurally, how do you remove a trustee that isnt doing her job? Do we have to go to court or can we remove her without having to go to court.

Before you start the process of trying to remove the trustee, you first need to see what the trust says. Does the trust require that that trustee provide an accounting? Is the trust silent on the issue? If so, then you will need to look at state law to se what the trustee requirements are to provide accountings to trust beneficiaries.

My father contacted an estate planning attorney and they contacted my aunt by registered mail demanding an accounting otherwise he threatened court removal. My aunt contacted the attorney and said that she was gathering information.

The trust says that the trustee has to provide the trust beneficiaries with periodic accountings. However, it doesnt say how often is periodic.

So, we are in the same position we were in weeks ago. If we sue, then we have to come out of pocket to remove her and then try to get reimbursed by the trust.

Its a pain. There should be an easier way to remove a trustee that isnt during her job.
