If i am required to sign a non-competition agreement and then am fired, is the non-competition agreement still effective and does it prohibit me from taking another job and soliciting clients from the other firm? I ask this because i was under the impression that a non-competition agreement are intended to protect the employer when the employee voluntarily changes jobs, but if the company folds and shuts down or if the employee is terminated, then i thought the non-competition agreement was null and void. Is there any thuth to that statement? State law is MA.

the spirit and essence of a non competition agreement is that it is to survive the relationship between the employer and employee for whatever reason and protect the employer from the employee stealing its clients/business.

The only way that a non competition agreement could be modified or stricken is if the non competition agreement violates public policy by being over-broad and too restrictive whereby severely limiting the employees ability to find alternative work
