in-law rights to see children 7 Years, 4 Months ago Karma: 0  
This question is for my a class project. State law is Texas

If parents are separated and one parent is in jail, can the parents of the incarcerated parent fill-in the shoes of the incarcerated parent and take over his/her parental rights to see the children? When do grandparents (inlaws) have rights to see grandchildren with the parents of the children are separated or divorced?

Most states, including Texas, have very deficient laws regarding the rights of grandparents to visit their grandchildren. Usually, if a mother dies and leaves behind children, the parental father can deny the grandparents the right to visit the grandchildren. The exception would be that grandparents may be able to be legal permission to visit with their grandchildren and serve as "de facto parents", which means that the grandparents take the place of the deceased parents because the grandchildren lived with the grandchildren or the grandparents took care of the grandchildren while the parents were at work.

A grandparent only has a limited right of visitation which will be must less than a divorced parent's right to visitation with his/her child. I also wanted to add that a grandparent's right of visitation is limited if the surviving parent decides to move with the kids to another state or even another country
