I have a client that has been working at this company for over 6 months. He was told he would be a W2 after a few months of being employed. However that has not happened. Client was even given a form that is filled out that says he would be a W2 after a few months that is signed by the employer. Client went to the office everyday as an employee and use the equipment there. Client worked full time hours as any regular employee. In addition, the client brought the classification issue to the attention of his employer multiple times and was told that employment status would change to W2 soon, but that it just had'nt happened yet. Now months have gone but, what cant the employee do to encourage the employer to withhold taxes from the employee and treat the employee as an employee rather than an independent contractor.

This situation happened to me. On the reverse side of the 1099 there are instructions on how to contest a 1099 that is improper or inaccurate. What i did was attach an explanation to my tax return and reported the income correctly. No problem.
