Attorneys are often friends with judges. Who do you think lobbies for judges to get elected or appointed to the bench? Judges have judicial canons of codes of professional conduct to follow, regardless of personal relationships with those in front of the court.

This ethics opinion raises the question of whether the first amendment has been breached by forbidding judges to "friend" attorneys on facebook. Sounds like the first amendment received a hair cut.

Being "friendly" and being out and in the open implies an undue influence and bias.

Kind of silly, but same idea why the govt gets mad when military leaders express political opinions in uniform, but don't mind (as much) if its in civies and offduty.

I think its important to point out that the ethics rules are aimed at protecting the public and the integrity of the legal profession. The ethics rule listed above is concern with improper solicitation of clients. It also important to note that even the announcement on Facebook of a jury verdict could, conceivably at least, be deemed to violate the ethical rules of many states, since they prohibit lawyers from stating the results of a specific case without a disclaimer that the results will vary in each case, or similar language.

I think the key is to just use social media responsibly in the same way we use other forms of communication like, facsimile, email and the telephone.
