If a property settlement provides that one spouse gets the marital home, and the property settlement is then filed with the register of deeds, does a new deed removing the ex-spouse need to be filed or does the property settlement clear the ex-spouse from title? I guess the question is whether the filing of a property settlement acts as a deed or whether a new deed needs to be recorded to clean the chain of title?
