I went to the doctor and he took a fluoroscope of a my leg. When i requested a copy of the fluoroscope the doctor's office would not release to me the fluoroscope. Can your physicians hold your medical information captive? Are physicians required to release your private medical information?

If the doctor billed your insurance or if it was on the statement of benefits then your doctor has it and you can sue him and compel the release of the fluoroscope.

Thank you Samantha. I finally found out that the doctor did not bill the insurance company for the fluoroscope but i'm sure that he took one. Is it possible that he didnt bill the insurance company on purpose so that he would not need to show that he had it and therefore it would not be discoverable?

Its possible that the physician was aware of its prior negligence and didnt bill for the fluoroscope. That would be very calculating.

I agree. In my situation, I believe that the doctor committed negligence and i needed to have corrective surgery and the negligent doctor is hiding the fluoroscope so that if i sue him he will not have to revel it in discovery.
