Provoking the fight can be considered an assault, but throwing the first punch is the battery. So, if you dont want to be charged with a crime, dont throw the first punch.

The first one to swing is guilty of battery. This thread reminds me of statements: my wife provoked me to hit her. The end result is that the guy goes to jail and the battered wife gets most of the property.
