I have a client who owns a shopping center. One of the tenants vacated the premises and left his equipment in the leasehold. The state now sent my client, the landlord a letter requesting information on the equipment. I can not find in the Illinois statutes where the state has the right to information from the landlord, unless there is a summons. The landlord has seized the equipment to cover past rents. My question is whether the state can make a claim on the property if the landlord has possession of the property and if no financing statements have been filed by the state?
