My mother slipped and fell outside on her neighbor's driveway and broke her wrist. My mother had surgery on her wrist and is happy with the results. On Saturday, she received a letter from the insurance company seeking subrogation rights and they are wanting information about where the injury happened and whether the neighbor had homeowner's insurance.
My question is whether we are required to answer this questionnaire and whether the insurance company will go after the neighbor's insurance. My mother doesnt want to bring the neighbor into this. Any recommendations?

It doesn't create any problem to the neighbour they just asked it only for the information and the insurance will be taken from your own insurance itself only....

The form states that the insurance company is looking for subrogation (i.e. a recovery) of benefits from the neighbor home owner. I advised the client to answer the questionnaire accurately.

Thats a standard letter sent out automatically by the insurance companies, usually reviewed by an attorney to see if there is a third party to cover all or part of the initial claim. Answer it honestly and let the insurance companies duke it out.

If you dont plan on filing suit to recover damages, then just tell the insurance company otherwise they will try to raise subrogation issues.

The insurance company just wants to assert their claims on any recovery you get. Thats the whole purpose for the form. If you tell them there is no claim being brought, then they will close their file.
