Has anyone researched if certain states have had a problem with the graders of the bar exam essay? Have there been instances of negligence or dishonest graders improperly grading bar exam essay?

One of my friends, who is a licensed attorney and solo practitioner said that he signed up with the Illinois state bar to be a grader on the essay portion of the bar exam. He said that he did it for the extra money. He also said that his job was to focus on the right buzz words, case citations and the structure of the essay. He did say that he afforded 3-5 minutes per essay max. So, does that mean that the essay graders were negligent or dishonest, i dont think so. I think its just that they have a quota to fill and a perfect essay should be essay to grade. The correct answer should not be buried in the essay.

Thats encouraging, 3-5 minutes per essay. No wonder people appeal their essay score and win, you have the graders skimming for magic buzz words, and missing other important factors listed on the essay.
I guess i dont understand the 3-5 minutes per essay. Is that because there are so many to grade or is that because thats what the state bar mandates? Are the graders getting paid by the minute?

I just had a conversation about bar exam appeals with a girl that graduated in May and took the July bar exam and just appealed her November bar exam failure and she got back 6 scaled points, enough to get licensed as an attorney based on appeal. Six points is a lot, especially since they were all from essays. That just goes to show you the "human error" associated with grading essays. Even if the graders have structured criteria that they are required to use when grading, they still have bias and use subjective criteria when grading.

Human error in grading entrance exams is a real problem. Thats why some many people pay $5k++ to appeal their bar exam results and many often win on appeal. Are there any stats on appeal success rates?
