I thought I may add that 401-K contributions are added back to the disposable income when determining whether the client qualified for Chp 7 or Chp 13

What happens in a situation where you had a substantial SEP, but you took loans against it? How is your loan money treated by the BK Trustee, assuming you spent it?

The loan receivable is considered as an asset that is counted by the bankruptcy court. Since the loan is by the bankruptcy applicant, the court may write it off as uncollectable. Results are based on a case by case situation.
