I am the owner of a small bakery which packages and sells to retail outlets. Recently, i discovered that my in house controller was issuing checks to venders and to himself without my prior permission. These checks have already cleared the bank and i am working with the bank to claw back these funds. The bank manager said that most of the check written will be hard to recover since my controller had authority to issue check and pay vendors and if i disputed the payment then i would need to litigate the issue with the vendor. I also called an attorney to get advice and assistance, but all the attorneys wanted to charge by the hour and would not consider taking the case by contingency. Therefore, if i cant afford to retain an attorney, my controller walks free and i remain the victim. I need to re-coup the costs of the loss, and the insurance company will not cover it as theft. if the checks were not authorized, was fraud involved or were they legit payments? If it was fraud, then notify the local police department. They can bring a criminal action and you can alway sue in district court pro per or small claims court.
