I am in the process of filing for bankruptcy. I am gathering information to give to my attorney. My ex-partner is trying to sue me for fraud, which is unfounded, but anyway, after my first meeting with my attorney i was told by my attorney that i could not discharge a lawsuit based on fraud. So, i wanted to find out if there is a way to get rid of the lawsuit assuming i lose at court.

just have a written settlement that says that the damages are not based on fraud.

I cant tell the outcome of the lawsuit from my ex-partner. But i understand what you are saying, if i lose the can, just make sure that any award to my ex is not labeled "fraud". I may have to settle with him and pay him in an installment agreement. Then how long would i need to wait before i put the remainder of the installment agreement in the bankruptcy petition?

I would force a settlement with your partner and get it under the bankruptcy petition. You will need to do this at least 45 days prior to filing.
