Uncontested divorces can be done without attorney assistance, just go to the family court in your area, ask the clerk for a petition of divorce paper, fill it out, file it, pay the court fees, and wait the statutory period "cooling off period".

If you ask the court clerk any legal questions, then they will probably recommend that you retain an attorney. The clerk's office doesn't give any legal advice.

Which state is this for?

The divrce application is in Washington State.

You are right the family court will not provide legal advice, I was just hoping they would show us the forms required to get the divorce finalized.

Check your court's local rules too.. The responding party may need to file a "response". Once everything is filed, you may need to file a stipulation judgment along with your "property settlement agreement" to get the divorce decree entered from the court.
Good luck.. divorce sucks...

Post edited by: coolparrot, at: 2008/01/31 21:43

Hey, thx for the advice. In the complaint for divorce its agreed that I will get the house. Do I need to file a new deed or is the divorce judgement sufficient? Thx again.

WOW, Nice guy.. Ya, you need to "quit claim" him off the title of the house and vest it as you, sole owner or however you intend title it with the county recorder. Again I have no idea what the local rules are in your county. The courts will not exercise your stipulated judgment. They will only enforce it if either party breaches. Make sure you get him off the house deed. It's easy. I did my whole Div propera and saved some $$. Is he paying you spousal or child support? Good luck with that. Are you currently in law school?
I'm taking the LSAT the day after tomorrow... YUCK!
