My friends wife filed domestic violence case 6 years after of filing the 498a. In the past 6 years they have not stayed together. She had moved for divorce in 2004 well before the arrival of the DV act. Now what is the remedy my friend can get. Can he go for a quash as they dont leave together. How can he avoic his cruel wife.

yes, the complaint under DV act can be quashed as the complaint cannot be filed retrospectively. your friend's wife separated when the act was not notified. your friend may file a petition in high court for quashing the proceedings.

Domestic violence is awful because it affects the victims for the rest of their lives and also affects those who are close to them. It is unfortunate because when children are involved it teaches them that's how they should treat others or how they should let people treat them. Women who are victims often feel trapped financially, or for other reasons, and feel that they have no other option but to stay in the violent situation. These women should create some sort of safety plan or escape route that they can follow when they fear for their safety or lives, especially when children are involved
