Gift Tax Return 1 Year, 1 Month ago Karma: 1  
Client died in 2007 and an estate tax return needs to be filed. Its discovered that a gift tax return should have been filed a few years back but was not. What should be done? How will that affect the filing of the estate tax return?

If there is a missing tax return then you must file the missing return before you file the estate tax return. I would obtain transcripts of tax decedents tax accoiunt from the IRS to find out what else is missing. Then once I file all required returns, I would draft a letter and attach it to the 706 stating that you are filing a previous form 709 and explain how you handled it. I would also contact the IRS and ask for their opinion and assistance.
