Hi all -

I have a couple of small websites, and I want to protect the name and (I think it's called) marks.

What do I have to do?

One of the names I use is also used by another industry (although also online). I'm I out of luck? Do I have to give it up or can I still use it?

Your marks need to protected (words phrases, symbols, etc). You need to file a trademark application with the US Patent & Trade Mark office. After the application is filed, others in the market will file a complaint against your usage of a preexisting mark, if applicable. If other have been using the same mark before you then you will have to litigate in order to stake your claim and protect your investment. I recommend that you hire a patent attorney to asisst you. Look up attorneys in your area for a referral. This is not something you want to take on yourself if you are unfamiliar with this code.
