Can an doctor/dentist have his clients waive malpractice claims prior to medical service?

Would such a waiver be unconscionable?

Some medical professionals do practice some form of waiver or something like escape from liability sort provisions before they get to serve any prospective patient. Generally that is an illegal practice. Specifically, waiver of malpractice claims prior to medical service is something unconscionable. Reason: You cannot waive something that does not exists or have not happen yet. The waiver can be interpreted as non-existent or something with like import.
