What type of internet interception is legal vs illegal? For example, can I pick up a local wireless network transmitting over your home. I know that wiretapping and phone tapping is illegal?

Phone tapping is not exactly illegal in all circumstances. By law, telecommunications compaines are required to cooperate in the "interception of communications" for law enforcement purposes. The statute is the Communications Assistance for Law Enforcement Act (CALEA), passed in 1994 (47 USC 1001-1010). Your carrier may be considered a telecommunications company (haven't read the statute).
