How long does it take for food poisoning to settle in? Client claims he got food poisoning from a restaurant within hours of his meal , and restaurant manager said that it takes 24 hours to develop food poisoning.

Client wants to sue for costs and pain & suffering

As I sense it,it relatively depends on what kind of poisonous material was involved.
One thing sure, whenever one experienced food poisoning, irrespective of the number of hours the poison could develop and irrespective of good faith, the victim has the right to be compensated for the resultant injury he/ she got from taking in the food that has poisonous matter.

it may be food poisoning or an alergic reaction. If food poisoning, use the medical records to file a complaint.

I'm not aware of any inbubation period or 12 hr requirement before you experience food poisoning.

I would definatley call the local health inspector and have them also investigate the premises. Thoses records could also be subpeoned and used in court.
