I am a self employed lawyer, of course. I am getting my taxes together and I am wondering if I can deduct my work clothes. I know certain professions can, and I figure I have to buy a certain type of clothing so I should be able to deduct it, right? I would not have so many ties otherwise.

i know that work clothes are not deductible unless they are used only for your trade or business, like a hard-hat, steel toe shoes; or a bullet proof vest.

Otherwise, everyone would deduct their clothing costs.

So as a professional I can't deduct what clothes I have to buy for work, but others can? How do you know the difference, or what is the difference?

In order to claim a deduction, the taxpayer must prove upon audit, that the expenses were:

1. Paid by the taxpayer,
2. Taxpayer must maiintain receipts and records describing the item and the amount paid
3. The clothing was necessary to carry on the duties of the position
4. The items can not be used for personal use (necessary for business)

Think: "amount, time/place, and purpose"

So, if business suits can not be deducted.

look at it this way: write down on your tax return Hugo Boss suit and guess whether you will be audited!

So the test is whether or not the article to be deducted can be used for personal use? So because I can use my suit to go to a wedding, I can't deduct it, interesting and seems bit unfair, because to me a suit is a necessary item of clothing for work. I can't go to court in shorts or jeans.
