The Kovel Rule has existed for more than 50 years. The Kovel Rule extend the attorney-client privilege to professionals retained by the attorney.

The Kovel Rule is being eroded away by the government in many district court cases. The Kovel Rule will protect communication between an attorney and a retained professional where the retained professional, e.g. an accountant, assist the attorney with with a specific matter which is usually described in an engagement letter.

The Internal Revenue Code, Section 7525, provides for CPA-client privilege, but that priviege is very limited and only applies to "non-criminal" tax matters.

So, if the engagement letter between the attorney and the CPA are specific enough and within the scope of the servcies provided to the client, then the Kovel letter will stick. Out of an abundance of caution, many attorneys will keep info away from their CPAs for fear then the CPA will get a grand jury indictment and make things worse for the client.
