if black mold is discovered in a recently purchase home, what recourse does the home owner has against the seller, title company, and the RE agent?

If the existance of black mold was know by the RE agent and seller prior to sale and it was not discovered, then you have a claim against them.

Usually, black mold is apparent on the surface and a home inspector should be able to identify it.

In many states, houses with black mold need to have the mold removed otherwise title (deed) to the house will be encumbered by stating that the house has black mold.

I'd also check with CERCLA for contaminated property rights.

black mold can occur anywhere on inside or outside a home. usually, a bleach solution will clean it up.

Black mold doesnt just happen. It develops over time, usually from water damages. Every house has some sort of mold, but breathing in black mold is as dangerous as asbestos.

In most states, the buyer can seek recoupment via for cleaning up the damaged area. Was the property transfered by warranty deed.

To expand on what Jacob said, black mold clouds title and decreases property value. Somewhere along the line, the seller, or the agent, or the inspector, or the appraiser should have discovered the problem.

How was the mold discovered & where? What is the time line from purchase to discovery of the mold?
