in states with no fault insurance laws, if an insured and an uninsured are in an accident and the uninsured caused the accident, then the uninsured may not have to pay the medical bills of the insured because the insured must look to his or her own insurance carrier for reimbursement or relief. My question is: If the uninsured causes the accident, in what situations can you go after the insurance policy of the insured passenger in the uninsured motor vehicle. I have a case like this now and i need to find a way to recover from someone's insurance carrier for my client's sake.

The insured passenger's insurance would only pay if the other vehicle and the driver were all uninsured
|

I think that coordinate the insurance benefits with the employment health insurance before they look at the passenger's insurance overage. If the passenger was injured and teh drives of both cars were not insured, then the passenger would use his or her employment health insurance to cover medical bills.
