My question involves injury or loss that occurred in the state of: MI
My 14 month old son was at daycare (been there for 1 yr) and received bad 2nd & 3rd degree burns on the top and bottom of his hand. He has no feeling in that area.

The daycare had not called 911, we just happened to walk in supposedly after it happened. We immediately took to ER, who then transfer to burn unit at another hospital and admitted.

The cause of the burn was a bottle warmer...but more consistant with a flat iron (curling iron) that caused the burn.

Social worker recommended we contact police, should we file police report or consult with a lawyer?

After reading your harrowing event I would make a police report, report the day care center to the sate since they did not follow procedures. First of all what was this curling iron doing there in the first place? Secondly why wasn't 911 called? I would have called 911 even if I felt the incident did not warrant the call at least I would not be held responsible for further actions. I would have then cooled the burn and done first aid until the paramedics came.

I would suggest you file a police report and take your child out of this place. Sue them for pain and suffering, medical bills,personal loss because your son might have issues with his hand, negligence and possibly Child Abuse because this iron had no place in a day care center or other place for even older children. And also they did not call 911 and you had to be there. Why didn't they call your cellphone to let you know what happened?

This is the day care center from h---. I am so sorry you had to endure this. Take action ASAP you need to find a lawyer who will work on contingency. Look up a Persona Injury Lawyer with your local University Law School. Possibly an intern can take the case on this basis as they are learning the profession. Remember sue for more and even if you get less at least you will make a big deal out of this.

Thank you for the advice. This has been a horrible experience. I contacted an attorney and she recommended that I create a log/timeline of events. This is my task and I am asking the other mothers to help me with the facts. Once done I will submit it to the attorney to include certain facts in the complaint.

I will keep you updated.
