car accident - no seat belt 4 Months ago Karma: 4  
client was in a car accident and was not wearing his seat belt. Client gets a ticket and is slightly injuried. PI attorneys will not take care because of contributory negligence. Client was not at fault. Was rear ended.

Suit is in Ohio. Any thoughts from forum?

i was in an accident where i wasnt partly at fault but i still collected damages and medical reimbursement.

Does contributory negligence prevent a claim in OH?

The issue of contribultory negligence is generally limited by statute in this situations. Most states that still have contributory negligence in these types of situations usually have the percentage set by statute for not wearing a seatbelt. It is usually offset by 5 to 10 percent of the overall judgment.
