Husband and wife are not getting along. Husband is not paying any bills, but the wife is. Can wife kick husband out of the house even if they have not filed for divorce yet?

Unfortunately, according to my understanding of spousal lock-out the answer is, no. She is stuck with him until she files for divorce and the court intervenes.

I know of a situation where the husband was abusive to wife and prior to filing for divorce, the wife obtained a court order removing the husband from the house and the husband was ordered to continue paying all the bills. I'd say file a petition with the court for removal of the dead beat!

I agree with Sarah's advice.

In cases where there is no domestic abuse, a spouse may still file a petition for removal of a spouse once an action for divorce commences. Of course, removal depends on the facts and circumstances. Facts such as domestic abuse and/or being a dead-beat parent will help your petition.
