There is an enhanced estate deed on grandma's property, but the nursing home is threatening to kick her out if her propoerty is not turned over to Medicaid. They say they can do that if there is no one living on her property. My husband and I were planning on moving into the house when I could find a job in the area. Do we have any options or ways to prevent losing the house to Medicaid? We live in Texas.

I think what they are saying is that your grandma's primary residence is the nursing home and the house is actually investment property. Not sure about TX law, but in FL, the valaue of a person's primary residence is not considered a countable assets for purposes of Medicaid eligibility.

You will need to find out how much income from the rental of the house grandma is permitted to have if she is collecting Medicaid. There are statutory limits to how much "investment income" Medicaid recipients can receive without having their Medicaid benefits penalized and recduced.

The house is not a rental property. What we are being told is that the house is "up for grabs" by Medicaid because no one is living in it. We intend to move into the house when I can find a job in the area. Is there any way to stop Medicaid from taking the house. We still want to live there.

So, if we say that she intends to return home, even though she's not, this can stop them from taking the property and we wuld be able to move in.
