I have been separated from my spouse for 6 years and i have not filed a tax return for at least 9 years. I have not been contacted by the IRS, but i think my spouse has. If i file my tax returns before the IRS contacts me, will that make me safe from criminal punishment? How should i handle? I'd appreciate suggestions. I want to do something soon.

If you have not file your tax return in 9 yrs, then i would contact a criminal attorney and have them arrange a meeting with the IRS criminal division to "bring you in" and submit original tax returns. If the IRS agrees to the meeting, they will likely waive criminal prosecution of the failure to file.

But, definitely contact an attorney for guidance.

Take Jano's advice. If you try to do a "quit filing", then you wont have the blessing of the IRS. If you contact CID and they bless the returns, then there is no audit. You just simply pay the tax, penalty and interest.

FYI, the penalty and interest will likely not be waived if you go in through CID.
