1st offense, DUI with kids in the car 2 Years, 4 Months ago Karma: 1  
My sister got a DUI two days ago in Kent County Illinois. She had two glasses of wine and then drove her mini van home. She was pulled over, blew over the legal limit and now has a court hearing on Monday October 26th. My question is wether anyone can say what charges she is likely to face in Kent County as a first offense. How will the charges be affected if they say that there were kids in the car? Will she be looking at jail time? Larger fines?

The charge is DUI and reckless endangerment? If not then thats what your sister should expect.
As far as jail time, its up to that judge. Whats the judge's history?

I think that if your sister was willing to drink and drive with kids, that the judge will want to make her learn a lesson so that it doesnt happen again.

Id love to hear how it pans out. Make sure you post the results.

i concur with 1whoknows. Definitely reckless endangerment and jail time is not out of the question. Dont forget the periodic breathe tests, pee tests, and AA meetings!

I had my sister start with voluntary pee tests, AA meetings and counseling prior to her October 26th court date so that she can show the court that she has taken actions to change her behavior and act more responsible. I'm hoping that the court will look favorably on her voluntary acts and spare her from having to do jail time. What do you think?
