In a BK do you have to disclose all potential lawsuits which you intend on filing or can you aviod disclosing the potential lawsuits and then file them after the BK is completed? What is the disclosure requirement in a BK?

You only need to list actual or pending claims. If you have not filed a claim/lawsuit, then your BK attorney may advise you to wait until the BK is complete. But, you need to respect the statute of limitations on the claim. Your BK may exceed the time statute of limitations on the claim and then you'll be SOL

Thats great advice. I am not sure when the statute of limitations expires on the potential claim. I will need to look into that. Thanks for the advice and direction!
