I've read a lot online about asset protection planning and using state law as a shield in order to create asset protection. However, my research did not yield much in the way of case law that supports the use of asset protection planning.

While i know that states like Nevada and Delaware have favorable incorporation statutes, i would like to know what people are doing; i.e. which asset protection techniques they are implementing to build asset protection planning.

Asset protection is most effective when you build the asset protection planning prior to a lawsuit. Otherwise, courts will deem the transfer of assets as fraudulent and done with teh intent to evade creditors.

Once of the best asset protection technics is to physically move the asset out of the country. Another example would be to give someone else control of the property. If you do not have control over teh property, then creditors will have less access to it.

I think that asset protection planning requires a macro view of a person's affairs. When you look at the whole picture you can better plan for the entire estate or for specific assets.

Can anyone recommend a book on asset protection planning?
