I had outstanding invoices with a client totally $3,450. This client, i found out, filed bankruptcy last month. I was not notified and not listed as a creditor. Now, i want to know if i can still collect from him. I am not sure how someone can file bankructy and all the creditors are not told? What are my options? How should i proceed trying to collect from someone that just filed bankruptcy?

if you didnt receive notice of the bankruptcy then your claim was not discharged and you can go after the debtor. its that simple. The problem you will face is collecting from the debtor.
Did you change your address since the debtor filed bankruptcy? Usually the address that you used during the 2 month period prior to the time the debtor filed bankruptcy is what the debtor used. Once the debtor files a bankruptcy petition, it creates an "Automatic Stay" and all creditors are supposed to obey it and stop billing the debto. A creditor who willfully violates the stay can be sued for contempt of court. Many creditors continue to send statements even after the bankruptcy has been filed.

What should my next step be? Notify the bankruptcy attorney or just go after the client? Does the case have to start at small claims court? Can i ask for attorney fees? How long will this take? And, if i go to small claims court, how can i ensure that i collect?
